The federal Workforce Investment Act of 1998 amended Section 508 of the Rehabilitation Act of 1973, under the amended Section 508, federal departments or agencies that develop, procure, maintain, or use "electronic and information technology" (EIT) must ensure that the EIT allows federal employees with disabilities to have access to and use of information and data that is comparable to the access and use of information and data by other federal employees. The amended Section 508 also requires that members of the public with disabilities who seek information from the federal departments or agencies must have access to and use of information and data that is comparable to that provided to the public without disabilities.
Pursuant to the regulatory framework established by Section 508 as amended, the federal Architectural and Transportation Barriers Compliance Board published on December 21, 2000 Accessibility Standards to define EIT and the technical and functional performance criteria necessary for accessibility. On April 25, 2001, the Federal Acquisition Regulatory Council published final rules that amend the Federal Acquisition Regulations to incorporate the Accessibility Standards. The amended FARs ("Section 508 FARs") are effective as of June 25, 2001. Quantum fully supports Section 508 and the efforts of the federal government in making technology accessible to people with disabilities. Quantum is committed to assisting its government customers in complying with Section 508.
It is Quantum's position that Quantum products are normally located in spaces frequented only by service personnel for maintenance, repair or occasional monitoring. Pursuant to FAR 39.204(d), this product is not required to comply with the accessibility standards at 36 CFR part 1194 published under Section 508 of the Rehabilitation Act.
